17. Indemnification
The Customer agrees to indemnify, defend, and hold harmless eSIM Station and its officers, directors, employees, agents, attorneys, insurers, successors, and assigns (collectively, the "Indemnified Parties") from and against any and all liabilities, claims, damages, costs, and expenses (including reasonable attorneys' fees) ("Liabilities") arising from or related to:
Use of the Services:
The Customer's use or inability to use the Services.
Breach of Agreement:
The Customer's violation or failure to comply with this Agreement.
Violation of Laws or Rights:
The Customer's violation of any applicable law or the rights of another user or third party.
Infringing or Unlawful Content:
Any content posted or transmitted by the Customer or through their account that infringes third-party intellectual property rights or is otherwise unlawful or inappropriate.
Automated Tools or Excessive Burden:
The use of software robots, spiders, crawlers, or similar data gathering or extraction tools by the Customer, or actions that impose unreasonable load or stress on eSIM Station's infrastructure.
Defense and Control of Claims
eSIM Station reserves the right, at its sole discretion and expense, to assume the exclusive defense and control of any matter that would otherwise be subject to the Customer's indemnification obligations.
Customer's Obligation:
The Customer agrees to cooperate fully with eSIM Station in the defense of any such matter.
Settlement:
The Customer will not settle any claim or matter without the prior written consent of eSIM Station.
This indemnification obligation survives the termination or expiration of this Agreement and the Customer's use of the Services.
