10. Representations and Warranties

Customer Representations and Warranties

The Customer represents and warrants that:

Legal Age and Competence:

They are at least 18 years old, or of the legal age required in their jurisdiction, and have the legal capacity to enter into binding agreements.

Authority and Compliance:

They have the right, authority, and capacity to agree to and comply with this Agreement and its terms.

If signing on behalf of a company or organization, they are authorized to act on its behalf and bind it to this Agreement.

The Customer further represents and warrants that they:

Acceptance of Terms and Laws:

Have read, understood, and agreed to the Terms of Service and Privacy Policy.

Will act in good faith and comply with all applicable local, state, and federal laws or customs while accessing or using the Services.

Prohibited Activities

The Customer agrees not to engage in the following activities:

Unauthorized Use of Services:

  • Copy, distribute, or disclose any part of the Services except as permitted.
  • Use automated systems (e.g., bots, scrapers) to access the Services without authorization.

Spam and Fraudulent Activities:

  • Send spam, phishing attempts, or other unsolicited emails.
  • Engage in fraud, misrepresentation, or activities that compromise system security or integrity.

Illegal Activities and Content:

  • Violate any international, federal, state, or local regulations or laws.
  • Upload invalid data, viruses, or malicious software.

Intellectual Property Violations:

Infringe upon the intellectual property rights of eSIM Station or others.

Misrepresentation:

Impersonate others or misrepresent affiliations.

Harassment and Abuse:

Harass, abuse, or harm other users, visitors, or eSIM Station personnel.

Interference:

  • Interfere with the security, functionality, or operation of the Services.
  • Attempt to decrypt, reverse-engineer, or bypass security measures in the Services.

Unauthorized Access:

Attempt to access unauthorized accounts or collect personal data of others.

The Customer agrees not to motivate, enable, or facilitate any of the prohibited activities listed above.

Disclosure of Motives or Intentions

The Customer guarantees and warrants that they have no hidden motives, situations, or interests (e.g., journalistic, research, or illegal purposes) in using the Services unless disclosed fully and promptly to eSIM Station.

The Customer agrees to notify eSIM Station in writing of any such motivations, situations, or interests prior to registration or as they arise during the use of the Services.

Application Use and Data Collection

By installing the application, the Customer consents to:

Automatic Updates and Communication:

  • The installation of updates or upgrades related to the application.
  • Automatic communication between the application and eSIM Station servers to ensure functionality and record usage metrics.

Data Collection:

  • The collection of personal information, including location data, as outlined in eSIM Station's Privacy Policy.
